• Cannabinoid vapes — this includes any cannabinoid vape, plus vapes marketed as containing kratom, kava, mushrooms, tianeptine, or alcohol.

• Disguised devices — the bill's sponsor aimed at vapes disguised as school supplies, office supplies, smartwatches, headphones, cosmetics, and toys.

• Youth-appealing packaging — designs that look like they're meant for kids are off the table.

For shops, the stakes are real. Selling a banned product is a Class A misdemeanor, which carries up to a year in jail and a $4,000 fine. That's why a responsible local shop checks every product before it hits the shelf.

What Did NOT Change

• Flavors are still legal. Texas targeted the country of manufacture instead of banning flavors.

• The age limit is still 21. Federal law raised the minimum age to 21 in 2019.

• Refillable vapes are not the target. Refillable devices and US-made e-liquids remain legal in all flavors.

Texas Law vs. FDA Status: Two Different Things

This is the part that trips people up. Texas rules and FDA authorization are separate systems. A product can be allowed under Texas law and still lack FDA marketing authorization. As of 2026, the only FDA-authorized disposables are the NJOY Daily and NJOY Daily Extra, in Rich Tobacco and menthol only. Most flavored disposables have no FDA marketing order, but they are not federally banned. 1. Read the label. Look for the country of manufacture on the box or device. If it lists China, Russia, Iran, or North Korea, it's affected by SB 2024.

2. Look at the design. If it looks like a highlighter, toy, or gadget, that's a red flag.

3. Check the product type. Vapes containing cannabinoids, kratom, or similar additives are restricted.
