• Youth-appealing packaging — designs that look like they're meant for kids are off the table.

For shops, the stakes are real. Selling a banned product is a Class A misdemeanor, which carries up to a year in jail and a $4,000 fine. That's why a responsible local shop checks every product before it hits the shelf.

What Did NOT Change

• Flavors are still legal. Texas targeted the country of manufacture instead of banning flavors.

• The age limit is still 21. Federal law raised the minimum age to 21 in 2019.

• Refillable vapes are not the target. Refillable devices and US-made e-liquids remain legal in all flavors.

Texas Law vs. FDA Status: Two Different Things

This is the part that trips people up. Texas rules and FDA authorization are separate systems. A product can be allowed under Texas law and still lack FDA marketing authorization. As of 2026, the only FDA-authorized disposables are the NJOY Daily and NJOY Daily Extra, in Rich Tobacco and menthol only. Most flavored disposables have no FDA marketing order, but they are not federally banned.
